PRICE BEAT GUARANTEE TERMS & CONDITIONS

1. Overview

  • Purpose: CBNSW offers a Price Beat Guarantee (the “Guarantee”) to give customers confidence that they are receiving competitive pricing on blinds and curtains purchased through our website: www.cbnsw.com.au.
  • Scope: These Terms & Conditions govern the manner in which our Price Beat Guarantee is applied and any exclusions that may apply.

2. Eligibility for the Price Beat Guarantee

2.1 Eligible Products/Services:

  • The Price Beat Guarantee applies exclusively to blinds, curtains, and related window furnishing services offered on our website.
  • The product or service must be identical in every respect (e.g., brand, model, fabric, color, size, inclusions) to the competitor’s offering for the Guarantee to apply.

2.2 Geographic Limitations:

  • The competitor must be operating within Sydney Metro area, offering the same product under similar terms of sale.

3. Competitor Criteria

3.1 Qualifying Competitors:

  • Competitors must be recognized businesses specializing in the sale of blinds and curtains.
  • The competitor must provide installation quotes and/or services comparable to ours (where applicable).
  • The competitor’s product or service must be readily available to the public under the same conditions.

3.2 Exclusions:

  • Promotion Periods: Any pricing that is part of the competitor’s special promotion period (e.g., clearance, flash sale, or limited-time promotion) is excluded.
  • Retail Outlets With Broad Product Ranges: Any large retail outlet or store primarily selling an extensive range of general home improvement products (i.e., blinds and curtains are not their specialty) is excluded.
  • Sole Operators: Individuals or entities operating on their own without a formal, registered business structure, or operating solely as independent contractors, are excluded.
  • Auction Sites/Marketplaces: Pricing found on third-party auction websites, online marketplaces, or classified ads does not qualify.
  • Bundled or Group Discounts: Offers that include bundled products, group discounts, or membership-only discounts are not applicable.

4. Proof of Lower Price

4.1 Evidence Required:

  • To claim the Guarantee, you must provide a written quote or an advertised price from the qualifying competitor.
  • The quote must be dated and must include specific details of the product or service (e.g., exact measurements, fabric, color, brand, etc.).
  • We reserve the right to verify the competitor’s quote, including contacting the competitor directly.

4.2 Currency & Timing:

  • The competitor’s quote must be in the same currency and must have been issued within 14 days of your claim to be valid.
  • The quote must remain valid and unexpired at the time of verification.

5. How to Make a Claim

5.1 Submission:

  • Claims must be submitted before placing an order with us or within 14 days of your purchase from us.

5.2 Verification Process:

  • We will review the details you have provided and verify whether the quote meets all these T&Cs.
  • If your claim is approved, we will provide you with the new price or adjusted refund/credit as soon as practicable.

6. How We Beat the Price

6.1 Price Adjustment:

  • Once verified and approved, we will beat the competitor’s price by “5% lower than the competitor’s price”.

6.2 Form of Adjustment:

  • If you have not yet purchased, we will issue a revised quote at the lower price.
  • If you have already purchased, we will refund you the difference via your original payment method, or issue store credit as per your preference (where available).

7. Exceptions & Limitations

7.1 Non-Transferable:

  • This Guarantee is offered to the original purchaser only and cannot be assigned or transferred.

7.2 One Claim Per Purchase:

  • Only one price beat claim may be made per purchase/order.

7.3 Availability:

  • We reserve the right to limit or refuse any price beat claim where, in our opinion, the Price Beat Guarantee is being exercised in bad faith or does not comply with these T&Cs.

7.4 Fraud or Misrepresentation:

  • Any claims that appear to be the result of fraud or misrepresentation are void.

8. Changes to These Terms

8.1 Right to Modify:

  • We reserve the right to modify, suspend, or terminate the Price Beat Guarantee and/or these T&Cs at any time without prior notice.
  • Any change will be effective immediately upon posting the updated T&Cs on our website.

9. Liability

9.1 Limitation:

  • To the extent permitted by law, our liability for any claim arising from this Guarantee shall be limited to the amount paid by the customer for the product or service in question.

9.2 No Additional Rights:

  • This Guarantee does not alter or replace any statutory rights or remedies available under applicable consumer protection laws.

10. Governing Law

10.1 Jurisdiction:

  • These T&Cs shall be governed by and construed in accordance with the laws of NSW. Any disputes arising out of or in connection with these T&Cs shall be subject to the exclusive jurisdiction of the courts in NSW.
